Who is Liable?
Hi,
I am a home owner of a flat. The block has a Factor that provides groundskeeping, the close clean and insurance cover for the block.
They also provide upgrades/modifications to the *rented* properties in the block.
One such modification involved fitting a new boiler and pipes to the rented property above mine.
Unfortunately the pipes leaked into my bathroom. The Factor repaired my lighting fixture, but it wasn't until some months later when the water/dampness started to dry out that cracks appeared in the plaster and damage to the underlying plasterboard.
I had to make a claim through the Factors insurance to get this resolved and I was under the impression that the Factor would be footing the £100 excess. Unfortunately I ended up paying for it.
Is there anyone that can tell me why I am out of pocket for modifications done to the Factors rented property above, which has then caused damage to my mortaged property?
Also, I'm in Scotland (incase there are any different factoring laws.)

The person responsible is the
The person responsible is the owner of the flat above.
He in turn might have a claim against the management company and contractor.
In England I would be telling you to write to the owner asking for the money.In default you would then be able to issue a small claim in the county court.
