Threats To Kill Allegations
Hello, I am looking for advice for my fiance and family, I will try to keep a long story as short as possible.
Basically the social services have hounded me like you could not imagine, they are saying that I could one day emotionally harm a child due to mental health problems though I can assure you there is nothing wrong with me and have had this confirmed by a different doctor. I was sectioned for my spiritual beliefs and forcefully medicated while pregnant for 4 days, a psychiatrist then assessed me and said there was nothing wrong with me I was released no follow up or medication.
Next thing a mental health social worker is phoning my fiances ex partner saying I am a risk to his children and am to have no contact. I was given the workers name written on a card.
The same day a mental health social worker surprised me with a home visit. I let them in, they said they wanted to check on me following the hospital incident. While the social worker was in my home I mentioned the calls made by social services and read out the name off the card. It turns out the same social worker was sitting in front of me.
At this point my fiance got up, he was upset and he said "I will end you". Now I know he meant her career, we had said we will get this investigated they cannot go around phoning people saying things about me with no evidnce preventing his children from coming to our home. My finance then walked out. The social worker and doctor stayed for a short while talking to me and then left.
This happened 2/9/11. Now about 6 weeks later 17/10/11 the police arrived at our home and arrested my fiance for threats to kill the social worker. He was kept for about 12 hours and released on bail. He is on trial next month at magistrates.
He asked his solicitor twice to see the statements made against him, the solicitor was reluctant to let him have them, it was only when I called and made a fuss did he finally send them to us, from the page numbers I can see he has with held some pages.
What surprised me when I saw the statements was that the social worker claiming to be the victim made her statement 6/10/11 3 days after the witness (doctor) who made his 3/10/11, this seems backwards to me. It then took them a further 2 weeks to come and arrest my fiance, they had not attempted to arrest him sooner.
I do not understand why someone who felt their life was in danger would wait over a month to contact police and why police would then wait 2 weeks to arrest him. There is no indication of what prompted her to suddenly feel threatened and call police or why the police suddenly felt promted to come banging my door down on 17/10/11. Nothing seems to add up.
The statement made by the social worker is not signed by her or the police and the doctors statement is signed by the doctor but not by police. Are these valid without signitures?
Within the statement there is a whole list of discrepencies, the two differ on what exactly was said and why, they also differ about the general mood of my fiance, the social worker made out like he was agitated and aggressive she used "fucking" a lot quoting him, the doctor however does not mention anything like this and you would think a psychiatrist would be the first to notice.
The whole thing stinks of a setup down to the social worker, the doctor, the police and the solicitor, surely even a half decent solicitor would have pointed all this out in the station. I had written complaints about the social worker asking for an investigation into slander, harassment and human rights violations. My complaints were dismissed due to the legal proceedings and she will not be investigated now.
The social worker went on to report us to child services who are assessing us. The only thing they had to say about my fiance in the whole assessment was about this incident, he is a quiet even docile man who has never been violent I do not know how they can do this.
3 weeks after the trial I am due to give birth, I have a horrible feeling they are trying to get him put away so they can target me alone for my newborn.

What type of advice exactly are you looking for as you haven't asked any specific questions beyond the statement signatures?
The fact is that Social Services have a duty to investigate issues such as you describe relating to mental health and potential harm to children, and whilst it may not be pleasant to those on the receiving end, the bottom line is that where children are concerned, their safety has to be paramount, even if it means hurt feelings for adults under investigation. That doesn't mean that an investigation is going to prove there is an issue - an investigation can equally show there isn't an issue. Unfortunately, due to your partner's reaction, further action has now been taken which involves the police.
Statements need not be provided by different witnesses on the same day, so there is no issue with regards to that. They may have removed the SW's signature for a reason - the copies do not need to be signed, they are merely for your information - those provided in court will be signed.
Social Services take threats against their staff very seriously (as they quite rightly should - it is a difficult job to do in the best of circumstances, let alone in the circumstances that most social workers deal with). You may have understood your partner to mean one thing, but the person it was directed to understood something entirely different, as did the doctor who witnessed the incident, and it was therefore reported to the police - just because the witness statements and the subsequent arrest of your partner occurred 4 and 6 weeks after the incident, does not mean that the incident itself wasn't reported on the day it occurred.
The police have investigated, and presumably interviewed your partner with his solicitor present, therefore they must also have had his side of the story too - did they interview you? The CPS clearly believe they have sufficient evidence to prosecute your partner on the basis of the police investigation, otherwise it would not be going to court.
