Tenancy Agreement

I have a tenant who signed a 6 month agreement through a letting agency, when it expired I issued my agreement, which gave a 2 month notice "get out clause". The letting agency agreement didn't have a "get out clause" but I feel it is fair to put one in (as circumstances can change).

My tenant didn't sign my contract, but has confirmed she received it, now they wish to leave in mid-contract giving 5 weeks notice. Is there aything I can do?

As I understand it the tenants had a 6 month written tenancy which has now expired.

As no written tenancy replaced the original agreement the tenant now occupies on a monthly tenancy. This means he has to give a month's notice of termination.

The landlord of course has to give two month's notice as is required by statute.

Sorry but it seems to me the tenant has given more notice than he needs to.
