Joint Mortage law
Submitted by liliani@live.com on Sat, 04/02/2012 - 12:55I am on a joint mortgage with my now ex-partner (we were not married) - the house is in the process of being sold and my ex-partner is now threatening to cancel the sale. I want the sale to go through.
Can I still sell the house even if he doesn't agree? What action do I have to take in order to do this?
Do i have rights?

I got custody as she was on drugs, and she has hardly seen him, but she recently dropped the bombshell that he might not be my son. After a D.N.A test, (not court issued) it turns out she was right...do I still have rights, or does she get custody of him?

Last will and testament question

If there are 2 wills for one estate what one counts, the scenario is as follows
mother in laws father died 8 years ago and left his will with the executor the will left half his estate to his only daughter and the other half to his wife who was to reside in the property until her death at which time the estate would be split 50/50 to daughter and wifes family.
The wife has recently passed away and her will is different leaving 3/4 to her family and 1/4 to daughter.

I had let out my property to a local council through one of their letting agents.
The three year letting agreement allowed the agent to cancel early provided they gave 28 days notice.
insurance company suing
Submitted by heathercarey25 on Fri, 03/02/2012 - 16:56My partner was involved in an car accident several years ago in which he suffered minor injuries and a fellow passenger suffered minor whiplash. The friend sued his insurance company for £4500 and now the insurance company are seeking that payout from my partner claiming that he missed one premium and so is liable to pay them. They have stated that they will send the documentation regarding this default. Can they do this?

Submitted by tom on Fri, 03/02/2012 - 16:21I have recently employed a solicitor to recover a debt of £15,000 owing in engineers fees. He issued a statutory notice to my client and has now sent a cheque. My solicitor is telling me that it will be at least 10 days to issue me with a cheque. This will mean that I will not get cleared funds for 2 weeks. Is this normal practice? Surely if the cheque cleared in 3 days I could be issued with a cheque or paid electronically then.

At the same time I undertook an appeal against the decision of the NHS not to fully fund my mothers Nursing Home fees. I instructed solicitors to act eventually at the Independant Review panel hearing I lost the appeal. My solicitors costs were £23,000+. The local authority are now seeking a legal charge over my mother's property to secure payment of the Nursing Home fees.
Car accident in heavy snow shower- who is liable

On the way to home while commuting, there was a heavy snow shower on 26th January on A417. It was very dark and the shower was so heavy that at a point couldn't see anything except the snow. Even the fog lights didn't help. As I was unaware where I was going, I just stopped my car.
