Tax return cash for tax
Submitted by Dirtyghost on Tue, 07/02/2012 - 13:49
Hi there, i recently recived a tax return which was nice so i took the check to my bank Lloyds and put it into my account and cashed it, all seems good...!
I have now recived an email from Cash For Tax stating i owe them nearly £350 for cashing the check and ther is an invoice attached with the email.
Now i'm very greatfull for the tax return it has come at a great time but why has cash for tax got involved... i have not signed any agreement with them or asked them to act on my behalf what should i do/do i have to pay them the money.
Many thanks Marti.

I have not come across tax
I have not come across tax for cash previously.
If you have no agreement with them then they should not be entitled to ask you for any money.
Can you scan a copy of their demand so i can advise further

Hi Marti, I agree with
Hi Marti,
I agree with Richard, if you do not have a contract with "Tax for Cash" then they are not entitled to charge you for anything.
It may well be that this is a scam and that these emails get sent out to everyone in the hope that the recipient is someone who has actually received a tax rebate.
Under no circumstances should you pay them and if Richard has offered to look at the email for you I would suggest that you take him up on his offer.

It transpires that i did sign somthing with this company in 2010 and in there small print it states that they have the right to hold this autority untill i advise them other wise.
I do remember signing with them but thought it was a 1 off thing, so i guess they have me dont they.....?
Regards Marti.
i can forward a copy of the sheet i signed but ill need an email addy to send it to.

Hi Marti, Yes if you signed a
Hi Marti,
Yes if you signed a contract with them then you are bound by the terms of that contract (subject to the terms not being unfair contract terms)
If their fee is in accordance with the contract then you will need to pay them and if you don't I would imagine that they will either instruct a debt collector or issue court proceedings against you.

The lesson here is always read the small print.
Many thanks for your time.

Far be it for me to go
Far be it for me to go against what fully qualified lawyers have advised you (I am only part qualified), but I wouldn't pay it. That term strikes me as being an unfair term - it's a contract that lasts in perpetuity - as far as I know it's only the selling of one's soul to the devil that requires that kind of clause!
But, levity aside, I would strongly suggest you challenge them on this contract. Did they actually DO something to help you gain a tax return? What is the nature of their business? What qualifies them to assist you with gaining tax back - if indeed they actually did anything?
In law, if a contract term is unfair, it can be struck out as if it didn't appear in the contract, though I think whether it stands should probably be looked at in conjunction with whether or not they DID anything to now be claiming money from you.
Ok a little more help then
Ok a little more help then please, could you qualified guys step in and thrash this out a little as £300 is alot to loose and if i really dont have to pay it then i wont.

You need to answer the
You need to answer the questions.
Did they actually DO anything in exchange for this demand for money?
Have they EVER done anything for you with regards to this contract?
What is the contract actually FOR?
Why did you sign up for it? What made you think it was a 'one off'?
I presume that you gave this
I presume that you gave this company quite detailed information to allow them to contact HMRC on your behalf to make the appropriate enquiries to enable them to apply for a tax rebate on your behalf.
If this is not the case then you may not have to pay them but it will depend entirely on the terms of the contract that you have signed and what they agreed to do for you.
You said in your initial post that you had no idea who they were and you then that you had actually signed something with them. What exactly did you instruct them to do?
My experience of these types of companies is that they usually charge a set fee or percentage of any rebate that they obtain on your behalf. a standing instruction of this type, i.e. where they do work for you on an annual basis and are only paid if they are successful is probably not an unfair contract term. However it really does depend on what the contract says.

Cash 4 tax
I had a letter asking the same from this company. The direct salesman sold it to me that they were going to help me claim back tax for the last 6 years and took the job details from that period, they then tang me asking for p45 details and I told them I wouldn't bother they now are asking for commission for a service they never provided. I have contacted watchdog, can you do the same?
Hi Megasone, Your situation
Hi Megasone,
Your situation is slightly different in that they have not actually provided your with any service. The OP appears to have received some service although he has not confirmed this.
Whether they are entitled to make some form of charge for the work that they have done for you thus far, i.e. looking at your P45s will depend on whether there was a term in the contract that you signed with them saying that they could do this.

Cash 4 tax
They are claiming I owe them a percentage of my recent tax rebate of which they had no assistance in as many people received rebates last Christmas without the help of a rogue company
cash4tax
dear sir/madam
concerning cash4tax, i believe i have been ripped off. I was approached by this firm in november 2010 asking if i would like to gain my tax back, i did not know i could so they said i would not need to do anything but hand in my p60s, i could not do this, so the man agreed to get them for me from work, and i would not need to pay anything unless i got a refund from them, so i signed a contract for them to do so. a few months later my payroll rang me asking my permission for them to send my p60s to cash for tax but this would cost me around £50 per item, so i refused. since then i have tried to contact cash for tax to cancell my agreement which they have not replied to me. I was also given a phone number on my contract and it belonged to a architect company {not cash4tax}. nearly a year later i had no reply and while i was at work i applied for my tax rebate through the rcn,[royal college of nursing]. from then i recieved a sum of £750 pounds. Last novemebr 2011 i had a phone call from a woman asking for my post code, i asked her what it was concerning and she said it was a letter from cash4tax, i asked her then what was it about and she promptly put the phone down on me.(i have not heard fro them in a year even after phone calls and left messages on answering machines) Days later a letter arrived stating i owed them £211.12 , this astonished me as they had not collected anything on my behalf or collected my money owing from the inland revenue, i did it through the rcn as stated. They have now sent the bill to a debt collector stating they will take me to court. Where do i stand as i feel they did not do what was stated in the contract and have never contacted me so i can voice my concerns to them. They have charged me the full 25% of the balance. now i owe more as the debt company is involved. i believe they have broken their contract. is there any advice you can give me please.
