Right to light?

We live in an end terraced house which has frosted opening windows to the bathroom and kitchen on the end wall. We have learned that planning permission has been granted for a building of equal height and in line with our house, to be built within 3 metres of our end wall.

Do we have any rights to light?

In the absence of any

In the absence of any specific right contained in your deeds or other document you would have acquired a right to light after 20 years uninterrupted access unless that right was enjoyed by reason of written consent or agreement.  The fact that the glass is frosted does not in my opinion make any difference.

Profile: I joined Sarginsons from university as an articled clerk in 1970. I am now the managing partner and have wide experience in all aspects of the law normally dealt with in private practice. I believe that a modern high street practice must adapt to the hefty demands of clients and deliver it's services according to the clients wishes.
