Police sit on evidence for 16 years - Huge miscarriage of justice

In 1992 Eddie Gilfoyle was convicted for murdering his pregnant wife, Paula Gilfoyle. Paula was found hanging in the garage of their marital home and had left a suicide note written in her own hand. There was no cogent evidence, forensic or otherwise, for murder. Yet, twenty witnesses and friends of Paula came forward at the trial to explain how happy she was and looking forward to the birth.

The court was told that there was nothing relevant in her background or upbringing that would have given cause for concern. In August 2010 after persistent and painstaking enquiries by Eddie's solicitor, the Merseyside Police finally handed over to the defence two five year diaries kept by Paula during her teenage years and her early twenties. These two diaries written in Paula's own hand reveal a very different Paula to that portrayed at the trial. They describe a previous suicide attempt by Paula when she was a teenager and a traumatic relationship with a previous boyfriend who she continued to see long after he was convicted of a brutal murder.

The detail and the events described in Paula's diaries might have had a significant effect upon the trial juries deliberations. The police had the diaries in their possession since at least 1994 and they were not disclosed to the defence in two failed appeal attempts in 1995 and 2000. From the beginning Eddie has always protested his innocence. He was released on parole in December 2010.
