Parking Ticket

My just son has just received a letter from Essex County Council with 2 photographs one taken at 2104hrs on 21 Jan 10 from the front of his car. Then one taken at 2105hrs from about 10m from the back of his car. The letter reads Civil Enforcement Officer CH158 had prepared a Penalty Notice but the vehicle was driven away before the Penalty Notice could be served. They now want £70, can they do that?
So annoyed money grabbing all the time.

I need to check a point before answering this question but can I assume that the vehicle was parked in an area where payment was required and that payment had not been made?

My Son had stopped to pick his friend up. He got out of his car went into the food shop to tell his friend he was waiting then went straight back to the car. There was no payment requirment just "unloading only sign". There is no suggestion by Essex County that He deliberatively drove off to avoid a ticket. My annoyance is that if the traffic warden had enough time to walk from the front to the back of the car and take a picture then he/she had enough time to issue a ticket.

Generally for a ticket to be valid the officer must hand it to the driver or fix it to the vehicle.
If the officer has started the process of issuing the ticket and the vehicle is driven away the penalty charge notice can be sent by post.
In your case you seem to have received a letter rather than a penalty charge notice.
You should get in touch with the council to say that no notice has been served on the driver or affixed to the car.
You should ask them to confirm that they will not pursue the matter.
If they do not confirm this you should use the appeal procedures which are pretty informal.
