Hi Tidd, I take it that this is unrelated to the situation you discussed in a previous post.
Generally speaking a Grant of Probate is only required when the assets of the estate total over £15,000.00. If your husband's parents did not own a property and had individual or joint accounts or investments each valued at less than £15,000.00 then it is quite possible that there would have been no need to apply for a Grant of Probate to deal with their respective estates.
I presume that your Husband would know how much his parents respective estates were at the time they passed away.
If they owned a property or had investments or savings worth more than £15,000.00 I would have thought that a Grant of Probate would be needed to deal with their estates.
If you would like to provide me with more details I can provide you with a more comprehensive answer. Out of interest did they each leave a Will or did they both die intestate and did they own a property?

HELLO GERARD, THANK YOU FOR YOUR REPLY. MY HUSBAND THINKS THAT HIS MUM LEFT A WILL BUT HIS OLDER BROTHER TOOK CHARGE AND DID NOT ASK TO SEE A COPY. HIS PARENTS DID NOT OWN THEIR OWN PROPERTY, BUT HE KNOWS THAT THERE WERE NUMEROUS INSURANCES TAKEN OUT. HIS YOUNGER BROTHER HAS JUST SAID THAT HE DID NOT THINK THAT THERE WAS A WILL. ANOTHER MYSTERY UNSOLVED.
WOULD YOU MIND IF I ASKED YOU ANOTHER QUESTION. THIS IS IN REGARDS TO MY PARENTS WILL, WHO DIED WITHIN DAYS OF EACH OTHER. THE SOLICITORS WHO HELD THE WILL WERE THE EXECUTORS AND THE WILL STATED THAT THE HOUSE SHOULD BE LOCKED AND AN INVENTORY SHOULD BE TAKEN. THE SOLICITOR INVOLVED DID NOT DO THIS, EVEN THOUGH HE KNEW THAT THERE WAS BAD FEELINGS ON MY BROTHERS SIDE TOWARDS ME. 4 AGAINST 1. REASON BEING THAT I RECEIVED HALF THE ESTATE AND 3 BROTHERS HAD TO DIVIDE THE OTHER HALF BETWEEN THEM. ALSO MY FATHER HAD TOLD MY MUMS BROTHER AND ONE OF HIS OWN THAT HE WOULD BE CHANGING HIS WILL IN MY FAVOUR, AS MY BROTHERS DID NOT DO ANYTHING FOR MY PARENTS, AND I WAS ALWAYS PUTTING MY PARENTS FIRST. IF MY DAD HAD LIVED THROUGH HIS BYPASS I WAS HIS NEXT OF KIN AND WOULD HAVE GONE TO LIVE WITH HIM, UNTIL HE WAS BETTER, AND MY CHILDREN WOULD HAVE VISITED ME EVERY DAY. THE THINGS THEY SAID ABOUT ME WERE EVIL AND ALL THE SOLICITOR SAID TO ME WAS WE NEEDED TO GET ON TOGETHER AND SORT IT OUT BY OURSELVES. I HAD TO SIGN A POLICE COMPLAINT FOR PHYSICAL AND VERBAL ABUSE. THIS WAS 2 DAYS AFTER MY DAD DIED. MY BROTHERS AND THEIR WIVES WERE IN AND OUT OF MY PARENTS HOUSE AND I WAS TOLD BY THE POLICE THAT IT WOULD BE SILLY TO GO THERE. THEY THREW SO MANY LOVELY KEEPSAKES AWAY, BROKEN, CAR OIL SPILT OVER EVERYTHING. THIS WAS ABOUT 5 YEARS AGO. I AM NOT GOING TO SUE BUT NOW I HAVE BETTER HEALTH I FEEL THAT I SHOULD DO SOMETHING, TO PROTECT OTHER PEOPLE.

Hi again Tidd, do you know the individual value of each insurance policy and what documentation was produced to the various insurance companies to cash in the policies? Has your husband questioned his older brother about what happened to the insurance policies or has he tried to contact the insurance companies direct?
In relation to your other question could you tell me exactly what the clause in the Will said about keeping the house locked, was this for a certain period of time i.e. until the administration of the estate had been completed? Or was it the case that the solicitor was meant to compile the inventory and then offer any contents to the beneficiaries?
The solicitor would have had fiduciary duties as a professional executor and would have been under a duty to follow all of the instructions given in the Will.
This was obviously a difficult situation but if you give me some further information I can advise you further.
