Matrimonial

In the last year I have separated from my husband.  He left the matrimonial home and agreed to pay half the cost of the mortgage.  I am in financial difficulties and it has come to the point where I can no longer afford to live in the property.  I have spoken to the Building Society and told them that I would be handing back the keys to them.  I have found alternative rented accommodation for myself and my 14 year old son.  My husband is refusing to pay half the rent on my rented accommodation, which incidentally a lot cheaper than the mortgage payments we were making to the Building Society.  Is he legally bound to help pay towards the rent because we have a 14 year old son.

Depending on your precise

Depending on your precise circumstances your husband is under a duty to maintain you and your child.

The duty so far as your client is concerned can be enforced in the absence of agreement though the Child Support Agency.

You can seek maintenance for yourself in the County Court as part of divorce proceedings.

Alternatively you could seek an order in the magistrates court on the basis that your husband was not providing reasonable maintenance.

The financial circumstances of both you and your husband would have to be revealed
