Insurance company wanting to sue

Hi, i did not know where to post this,
is it right that an insurance company can sue you for the acts of someone else? basically back in 2006 my cousin bought a car off my father and two days later my cousin crashes the car into some stationery vehicles, my cousin was convicted of this as he had no insurance and prosecuted in a court. Four months ago my father received a letter from his insurance company stating that because the car was still in his name at the time of the incident the insurers of the stationery vehicles will be claiming from his insurance and now his insurance company wants to claim from him and want 44 thousand pounds. My father passed away on 6th of this month

I went to see the solicitor
I went to see the solicitor that was representing my father on this matter, my father had paid him 1400. This solicitor told me that the insurance company are now not going to sue as long as my father does not claim for expenses.... last week i received a letter from the same solicitors stating that the insurance company have now changed their minds and now want to sue....i rang the solicitor and he told me that as long as i pay him to fight this case we will win and if i dont the courts will grant the insurance company the right to sue my fathers estate. Im baffled..it sounds like im being conned....this to me is a ridiculous case
