ok here goes,

Ok so I own a citroen c3, It was involved in a crash a van reversed in to it, when i tryed to drive the car home the engine light was flashing and it would not drive over 20mph
I took the car to my local bodyshop and they gave me a courstey car and rung me 3-4 weeks later saying the car is finished.
When i picked the car up i had it for 2 days and the engine light came back on and on the 2nd day it would not start I rung the garage back up and explained the situation to him he offered to pick the car up and check it again.
He has since rung back and said the car not starting and the engine light has nothing to do with the crash ?????
he wont give me my car back untill i pay him £70 recovery fee and £20 a day storage.
Ive since found out the garage never told the INS inspecter about the engine light and also he is claiming £150 recovery fee after the accdent he never recovered the car i took it to him.
So i have to pay him 4 days at £20 and £70 recovery fee and still get a car that wont start,
Ive rung the solicters that was acting on my behalf and they are saying because i signed when i picked the car up there is nothing i can do also the garage is saying i asked him to pick it up
I just dont have the funds to pay to get the car back and its not running, what can i do please help, I dont know what to do.
The car is in my girlfriends name and not mine, so Iam thinking if he keeps saying i asked him to pick it up does he not need permision from the owner? Iam not the owner my girlfriend is?

My girlfriend went to see the garage owner and he has said if she signs and says that the engine light is not a result of the crash, he will hand the car back over to us,
She has signed for it and we can now pick it up.
Iam mad at her because now we have a broken car, and if its the ecu or bsi the repair bill can run in to the £100's

The first thing that I would say is have you contacted your insurers or the insurers of the driver of the van? The fact that the engine light came on and you were not able to drive the car at a speed over 20 mph immediately after the crash would indicate that the problems were caused by the crash. You should therefore be liasing with your insuracne company about this.
What is the significance of the garage asking your girlfriend to sign a disclaimer saying that engine light fault and associated problems were not a result of the crash? Did you contact your insurers and did they refer you to this particular garage to carry out the repairs?

This is the first time ive made any claim on any insurance policy,
The way I went about it is, after the crash I took the other partys details and just took the car to my local body repair shop, they said they will take care of the rest they appointed me a solicter to deal with the matter and gave me a replacement car.
since reciving the car back it not working and the garage picking it up again, Ive phoned my INS they said the matter is nothing to do with them and I have to contact the other partys INS
The other partys INS are saying because the garage never told the vehicle inspector they sent out about the engine light they cant do anything about it Its now down to me to have it fixed.
Ive phoned the solicitors the garage apointed for me and thay are saying because i signed when i picked the car up they cant do anything.
And now my girlfriend has signed this morning at the garage to get the car back a statement saying the engine light and the car not starting is nothing to do with the crash
He said sign and you can have your car back.

A little update,
I got the car back and It still would not start, I rung a mobile auto mechanic, He fixed the problem in 30mins apperatley the crash dislodged a engine sensor and the car was over fueling, cost me £65 but now the car is up and running with no problems.
Iam glad it was such a simple job and nothing major.
surely they have procedures in place for cases such as mine? It was wrong for the INS and the solicitors that were surposed to be acting on my behalf to just say its down to me to prove the car not starting is down to the crash,
I think that you should try
I think that you should try to discuss the situation again with your solicitors and ask them to pursue the other driver's insurance company for the cost to repair the engine damage. As they are already acting for you they should really be able to advise you as to what to do next.
Hopefully you should be able to recover the cost of the engine repair if your solicitors can show that the damage was caused as a result of the accident.

its been a very long time
its been a very long time since this crappy firm fixed or tried to fix my car, the bottom line is the eml came on as a result of the crash and they failed to notify the ins inspecter, I had a strong case against the garage I went to see TS, it was to much hassle for somthing that only cost me £65 to fix.... since this has happened I had another crash in the c3 some1 hit the side of me on a roundabout in oldham, took my car to a diffrent garage and the work was 2nd to none, 100% better then the last cowboys I used......... And even gave the car a clean for me. my sister had a small bump and asked were she should take her car I gave her the name of the garage I used my dad needed some work on his 308 large dint on his rear door, so in the end they shafted me but lost 3 jobs also..... my sister also has some rust around her petrol cap that she needs fixing she asked me who can I take it to, guess who i wont take her to.....

I do have all the old receipts and even the print out from the other garage saying it was a ecu fault, and tried to get me to send my ecu off to be checked for errors... that is your other garage? lol. they tried to charge me £30 for that azwell until I stated I wasn't happy with what they were saying.. he soon changed his tune when I showed him the car working all fixed and running sweet with nothing to do with the ecu.... or the alternator for that matter.... I will scan the paper work for you to see Mr rip off garage owner!

is it to late for this, Its been a long time and I no longer own the car, after the mans outburst, I will look in to it again trading standards said I had a strong case last time i spoke to them I still have all the paper work and all the receipts, please say its not to late because now Im going to go all the way with this!!!!
