Freeholder problems

I have purchased a flat in a house converted into 6 flats. We have all finished our renovations. The lease states that the freeholder is responsible initially to renovate the communal areas, to comply with fire regulations, asbestos report, paint and decorate, at his expense. This was also confirmed in our solicitors enquiries when we purchased. He now states he is not prepared to do this and the 6 leaseholders have to carry out this work. Can he do this.
