Floodgates Opened for Childrens Criminal injuries cases?
A recent decision of the Appeals Tibunal ( of the CICA)found in favour of a young boy, aged 3 at the time he was assaulted, who claimed compensation following an attack with a metal bar by a fellow 3 year old.
As usual the press used emotive terms such as "opening the floodgates" to describe the consequences of such a decision. It was the first case of its kind as the scheme only compensates the victims of crime, and ordinarily a three year old does not have the capacity to commit a crime.
The press do not seem interested in the suffering of the Victim or the fact that the scheme is intended as a show of public concern for the victim. They appear only to be happy when trying to convince the public that we are descending the downward spiral to a compensation culture.
Against a statistical background of the number of claims falling year on year, can the British media not see the value that can be added to the lives of both the severe spinal or brain injured client and those with more minor injuries alike. If it were them would they not wish to claim?
