Fighting group launches to salvage HIPs industry

I am not quite sure what legal action  could be taken.

They must be thinking of a Judicial Review but if the government of the day repeals Part 5 of the Housing Act 2004 then a Judicial Review would be not available to overturn the will of Parliament expressed in an Act.

Of course the relevant Minister does have power under section 162 of the Act to suspend the operation of the HIPs' regime. If this were to happen then this decision would be open to review by the courts but such an application is not likely to succeed if the Minister followed the proper procedure in making his decision.

Costs would in all likelihood exceed £30000.00.

At a seminar today it was confirmed that AHIPP would attempt a judicial review if a new conservative government used section 162 to suspend the compulsory element of the HIP legislation.
