Consent Orders - What Am I Entitled To?

Hi,

In 2009 I divorced from my husband. We had been together since 2002 and got married in 2007. We had no children together. I divorced my husband on unreasonable behaviour and my ex-husband did not contest this. I left the marital home with just the clothes I was wearing and nothing else as the relationship had got that bad. As part of the divorce there was no financial settlements agreed.

Whilst we were together he took over his parents mortgage which is now his name and is his asset. Since we split up he has allowed £15k worth of arrears to build up on the mortgage that I am tied to. I have tried to get my name removed from the mortgage but whilst there are arrears on the mortgage the building society are unwilling to do this. I should point out that during the marriage I never contributed to the payments and I was only ever added as a security measure in case anything ever happened to him. However, I invested money into the property that was a settlement from my previous marriage.

The house is up for sale but at an unrealistic asking price and he is unwilling to drop it as he says it will not cover the outstanding balance. Therefore I know that it is never going to sell.

It looks like now I will be tied to this mortgage for the remainder of the term and I do not want to be penalised financially because of this for the next 20 years.

I have been informed that I can look into consent orders that will allow me to pursue my ex-husband for a financial settlement in terms of his assets. I assume this will cover things like the house in our names, other property, pensions, savings etc?

Can anyone advise me if this is correct and how I would go about arranging this. I can't afford massive legal fees as I literally have walked away with nothing and I have no assets whatsoever.
