communal waste pipe

we stay in a bottom flat in a close of 16,all flats are privately owned and we each pay £30 per month towards a building association. Myself and next door neighbour are continually having our bathroom and kitchen flooded with human waste. The waste pipe is a communal pipe which runs from the top of the building to the ground floor. I arranged for dynorod to come out and blast this pipe and informed the chairperson of the association that I was doing so and that on completion of job the cost had to be paid in full,she then left and went out. Dynorod came and completed job before she returned and I paid for the job which was a total of £136.20. When the chairperson returned we gave her the full reciept and now she is saying its not the assocations responsibility and we are not getting the money back which we have paid to dynorod can you please advise us on this please. We stay in Scotland.

The problem I have here is that you appear to live in Scotland and as we know Scotland operates a totally different legal system from that in England and Wales.

Normally you would have to look at your lease which would define your responsibilites and those of the management company.

Generally speaking services which serve more than one flat would be a management responsibility but it would depend entirely on the wording of the lease.
