Anti social behavior from neighbour

I have had noisy neigbiurs for the past three years just this week the council have witnessed the noise. We are private owners they rent the police were supposed to arrest last month, the council have put nuisance order on them for rubbish they have a date to move out but not until may I have asked the council and police for help not getting much. Two questions really what else can I do and also can itake their landlord tocourt for the suffering and abuse we have had to put up with us we are unable to sell our house.

The council is of course

The council is of course obliged to investigate all complaints of unreasonable noise.

It's officer will almost certainly ask you to keep a record detailing times, duration and the nature of the noise.

If the council decides the noise constitutes a statutory nuisance they will issue a Noise Abatement Order on the offender.

If he does not comply the council can seize equipment and/or bring the offender to the magistrates court.

The council might also consider an Anti Social Behaviour Order (ASBO) if the offender is particularly troublesome.This enables the council to involve the police.

Under sec 82 of the Environmental Protection Act 1990 you can issue your own proceedings in the Magistates Court.

You can also bring an action in the County Court for damages for nuisance.You would be able to attach to that action an application for an injunction seeking an end to the offending behaviour. Again this likely to be very expensive.

I do not think that you have a claim against the owner / landlord of the adjoining property.

I cannot however imagine the council will move very quickly as the offenders may well have left the premises before action is taken if it is the case that they are leaving in May.

Thanks the police have arrested my neighbour and cautioned her,the council are also serving her with a noise abatement notice plus she has been given an eviction notice however, my family and I are getting threats from her friends however the threats are not to our facebut through our Walls what can we do . These people are very dodgy and in to all sorts thanks

There are civil remedies but the cost would high.

You have to rely on the police in these circumstances.
